THE APPLICANT UNDERSTANDS AND AGREES THAT CORPORATE STAFFING SOLUTIONS (HEREINAFTER “THE COMPANY”) IS ACTING AS A REFERRAL SERVICE ONLY AND THE DECISION TO EMPLOY THE APPLICANT IS FROM THE COMPANY’S CLIENT SEEKING RECRUITMENT SERVICES. THE APPLICANT UNDERSTANDS AND AGREES THAT THE COMPANY DOES NOT GUARANTEE APPLICANT’S REFERRAL, PLACEMENT, EMPLOYMENT, COMPENSATION, OR TERMS OF EMPLOYMENT. THIS SERVICE IS AT NO COST TO THE APPLICANT.
THE COMPANY IS NOT APPLICANT’S EMPLOYER
AND APPLICANT UNDERSTANDS AND AGREES TO NOTIFY THE COMPANY IF THE CLIENT HIRES OR OTHERWISE ENGAGES THE APPLICANT’S SERVICES.
INTRODUCTION AND REFERRAL SERVICE DISCLAIMER
Please read and review the following 4 disclaimers. As the Applicant, you must accept and acknowledge each disclaimer in order to be considered for placement.
Authorization to Release Information Disclaimer
I hereby authorize the Company, its employees, agents, private investigators or any representative of the aforesaid company, to perform investigations into my background, past behavior, to my character, general reputation, and mode of living. In addition, I further authorize investigations of the following:
Investigative Consumer Reports
I authorize the Company to perform investigative consumer reports that may include credit reports, criminal history or arrest records, workers’ compensation histories, motor vehicle records, employment and unemployment records, military records, or other sources of information.
Education
I authorize schools, colleges and all scholastic institutions to release any and all information requested. This includes transcripts, grades, attendance records, and any other information requested.
Employment
I authorize all former and current employers to release any and all information regarding my employment history. This includes all information contained in my personnel file, salary history, condemnations, and all other pertinent information. I further authorize my supervisors and other work associates to disclose their opinions and observations of my work habits, qualities, competency, and skills. Furthermore, I authorize full disclosure of any and all drug and alcohol testing results.
Authorization to Release
I authorize custodians of the records of any agency, government agency, or company as described above to release such information upon request of any investigator, agent, or representative of the Company. I understand that any or all of these investigations or inquiries can be performed prior to and periodically throughout the duration of my employment.
10-Panel Drug Screening
I give my permission to undergo a 10-Panel Drug Screening Test and I am aware that the results of all screenings will become the property of the Company and will become a permanent part of my application at the Company.
Re-disclosure
I understand that the information requested is for the use by the Company and may be re-disclosed only as authorized by law. I understand that I have the right to request from the Company a written disclosure of the nature and scope of the investigation conducted that I authorized above.
Indemnification
I indemnify, release, and hold harmless the Company, any agents of the Company, or others reporting to or for the Company, any investigators, all former employers, reporting agencies, and all those supplying references and character references, from any and all claims, defamation, demands, and/or liabilities arising out of, or related to, such investigations, disclosures, or admissions.
Signature
Copies and facsimile transmissions of this authorization that show my signature are as valid as the original release acknowledged or signed by me.
Citizenship Disclaimer
In compliance with federal law, all persons hired will be required to verify identity and eligibility to work in the United States and to complete the required employment eligibility verification form upon hire.
Introduction and Referral Service Disclaimer
It is further understood that THE APPLICANT IS NOT EMPLOYED BY THE COMPANY and that the Company provides an introduction and referral service only. It is further understood and agreed that the Applicant understands and agrees to notify the Company if the Client hires or otherwise engages the Applicant’s services. The Company assumes no responsibility whatsoever for any actions concerning the placement, nor compliance with state or federal laws concerning employment, immigration, residency, insurance, taxes, or other legal requirements, all of which shall be the sole and exclusive responsibility of the Applicant and for which the Applicant agrees to fully indemnify and hold harmless the Company. Also, all payments for City, State and federal taxes, in connection with the Applicant’s employment herein, shall be the sole responsibility of the Applicant and/or employer.
This Agreement constitutes the entire agreement between the Company and the Applicant and supersedes all prior oral and written agreements between the Company and the Applicant with respect to the subjects covered in this Agreement. This Agreement shall not be amended or modified except in a mutually agreed upon writing signed by the Applicant and an authorized representative of the Company expressly stating an intent to modify or amend this Agreement.
The Applicant represents that he or she has carefully read and fully understands the scope and effect of all of the provisions of this Agreement; that he or she has had all such time that he or she desires within which to consider this Agreement; that he or she has had the opportunity to consult with an attorney of his or her own choosing and at his or her own expense to review this Agreement; and that he or she has availed himself or herself of this opportunity to the extent, if any, that he or she wished to do so.
The parties hereby certify, represent and warrant that they have carefully read this Agreement, that they fully understand its final and binding effect, and that they agree to all its terms and conditions.
